Reasons To Hire A Divorce Attorney For An Uncontested Divorce Case

If you rent a house or an apartment, it's very beneficial to know the laws that protect tenants. Hi, my name is Sally Riddell and when I moved into my first apartment, I wanted to make sure that I knew all of the laws concerning the rights of tenants. I researched tenant laws and I also spoke with a family friend who is a lawyer to make sure that I understood my responsibilities and rights as a tenant. Because I knew this information before I started renting my apartment, I felt confident when signing my rental agreement. If you're considering living in a rental home or apartment, I suggest that you read my blog first. If you are already renting, this blog will also help you if you ever have any concerns.

Reasons To Hire A Divorce Attorney For An Uncontested Divorce Case

In many cases, filing for divorce no longer means needing to prove that grounds for divorce exist. Instead, if both parties agree that there are unreconcilable differences, the parties may choose to file for an uncontested divorce. Generally speaking, uncontested divorce cases are much simpler than traditional divorce cases and can often result in fewer court appearances and a shorter waiting time before a divorce decree can be issued. However, this simplified process does not always mean that there is no need to hire a divorce attorney. In fact, there are several reasons why you may still want to hire a divorce attorney even if you are planning to file for an uncontested divorce. You can learn more about two of these reasons below.

Reason #1: There Are Issues Of Child Support Or Custody

If you and your spouse have children together, your divorce case will also address issues of child support and custody. A parenting plan will need to be submitted to the court along with your petition for an uncontested divorce. If you and your spouse are struggling to agree on these issues, it could result in the judge being forced to issue a ruling on these matters. In some cases, the need for this type of court order can result in a full-blown custody battle. Typically, this is not good for either the parents or the children. Thankfully, a divorce attorney may be able to help mediate an agreement between you and your spouse that will allow you to avoid the need for judicial intervention. If you are not able to avoid taking this issue before a judge, your divorce attorney will also be able to present your case to the court and help increase your chances of a favorable outcome in this matter.

Reason #2: There Are Issues Regarding Property Division

Just as you and your spouse will need to agree on issues of child support and visitation, you will also need to agree on how your assets and debts are divided after the divorce is finalized. The more assets you and your spouse have accumulated, the more complex this task is bound to be. The mediation services offered by a divorce attorney can also prove quite useful in resolving any issues that you and your spouse may encounter when trying to agree on how to divide your marital property. A divorce attorney may also be able to offer assistance in proving the existence of additional assets that your spouse may be trying to hide. For example, if you believe your spouse has additional funds that are not being disclosed, a divorce attorney may be able to help you get proof of these assets so that they can be included in the divorce settlement.
